These Terms of Use ("Terms") govern your access to and use of the früt website at frut.energy (the "Site"). Please read them carefully.

01Acceptance of these terms

By accessing or using the Site, you agree to be bound by these Terms and by our handling of your information as described in our privacy practices. If you do not agree with these Terms, please do not use the Site.

If you are using the Site on behalf of an organization, you represent that you have the authority to accept these Terms on its behalf.

02Pre-launch nature of the site

früt is preparing to launch. The Site is currently informational: it describes the früt brand and our planned products, and lets you join a waitlist or a supplier list. No products are sold through the Site.

Joining the waitlist or the supplier list is not a purchase, an order, a reservation, or a guarantee that any product will be available, offered for sale, or available to you in any particular place or at any particular time. Product names, flavors, ingredients, pricing, packaging, and availability are all subject to change before launch.

03Communications

When you join our waitlist or supplier list, you consent to receive emails from us related to that list — for example, launch updates, product news, and supplier or stockist information. We may use the contact details you provide to send these messages.

You can unsubscribe at any time using the link in any email we send, or by contacting us at contact@frut.energy. We will honor your request promptly.

04Acceptable use

You agree to use the Site only for lawful purposes and in a way that does not harm früt or others. In particular, you agree not to:

• misuse, interfere with, or disrupt the Site or its underlying infrastructure;
• attempt to gain unauthorized access to any part of the Site, accounts, systems, or networks;
• scrape, harvest, or collect data from the Site by automated means without our prior written permission;
• introduce malware or any other harmful or malicious code; or
• use the Site in any way that violates applicable laws or the rights of others.

05Intellectual property

The früt name, the früt logo, and all content on the Site — including text, graphics, images, design, and layout — are owned by früt or used with permission, and are protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, or otherwise use the früt name, logo, or Site content without our prior written permission, except where such use is permitted by law.

06Product & health disclaimer

früt is an energy drink that contains 160 mg of caffeine per 355 ml can. It is not recommended for children, people who are pregnant or breastfeeding, or anyone sensitive to caffeine. Please consume responsibly and in moderation.

Information on the Site about früt is provided for general informational purposes only and is not medical or nutritional advice. If you have questions about whether früt is right for you, consult a qualified healthcare professional. Flavors, ingredients, formulation, and availability are subject to change before launch.

07Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on it is complete or accurate.

08Limitation of liability

To the fullest extent permitted by law, früt and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill, arising out of or related to your use of (or inability to use) the Site. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.

09Third-party links

The Site may contain links to third-party websites and services, such as our Instagram page. These are provided for convenience only. We do not control and are not responsible for the content, policies, or practices of any third-party site, and a link does not imply our endorsement. Accessing third-party sites is at your own risk and subject to their terms.

10Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law principles, and any disputes relating to these Terms or the Site will be subject to those laws.

11Changes to these terms

We may update these Terms from time to time as früt grows and approaches launch. When we do, we will revise the "Last updated" date above. Your continued use of the Site after any update means you accept the revised Terms.
